Terms and Conditions

PLEASE READ OUR CURRENT TERMS BELOW. LAST UPDATED ON 01/06/2024.
NO TITLE TO THE GOODS SHALL PASS TO THE PURCHASER UNTIL PAYMENT IS RECEIVED IN FULL.
INVOICE TERMS ARE STRICTLY SEVEN DAYS; except where arranged on an individual basis. All deposits are to be paid within the first fourteen days of the invoice start date, unless other prior agreements have been made, after which H.G.Bespoke reserves the right to charge interest at the standard Statutory Interest Rate of 8% plus the Bank of England ‘Base Rate’. 
Deposits are non-refundable on stones where the stone must be purchased to remove it from the open market. Deposits on manufacture are to pay a small part towards the materials for your piece so are also non-refundable. Deposits on stock items are refundable, however you will have to inform H.G.Bespoke in writing within the first 28 days of any invoice/invoices. An administration charge of £250 will be applied and deducted from all cancelled orders of stock stones or metals, to cover expenses and/or refurbishment.

H.G.Bespoke reserves the right to charge interest on a daily calculation and add this late fee to any outstanding invoice/long invoice, or contract invoice payments at the end of each business day, at which point additional fees will be compounded.

All payments must be made by BACS payment only. No cash will be taken as full or part payment on any invoice or as deposit, H.G.Bespoke is not a cash business, and is MTD compliant. Deposits on any stone; purchased in full for the client by H.G.B; acting on behalf of the client, will be paid on a non-refundable basis.
If a Bespoke commission is cancelled within 14 days of the start date, prior to the purchasing of stones or materials you will not need to pay the full value of the commissions invoice regarding the manufacturing of your piece but will lose a Materials deposit after this once materials have been acquired/hedged to maintain the quoted costs.
In the event of a client cancelling a commission after deposit has been paid and once a stone has already been purchased for the client, or the piece has already been part made and all materials purchased, the client will still be liable for the full cost of the finished piece. Once paid in FULL H.G.B can then assist; on a case-by-case basis; and only where possible, in the re-sale of your piece on the H.G. Bespoke page for a 5% sales and administration fee.
Orders for stock pieces reserved with a deposit; and on either long or quick pay invoice, that are cancelled within 28 days will be fully refunded; less any losses due to the return and administration fees, the item will be returned to stock.

Any stock item purchased and removed from the H.G.B workshop wishing to be returned will need to be returned in an unworn, workshop perfect state. Damaged, worn, used, or any stock item sold with modifications such as; but not limited to, sizing and engraving will not be eligible for refund.

H.G.B can help in the re-sale of unwanted items that have been damaged by the client and; if required, the reconditioning of unwanted items to their workshop perfect state prior to assisting in the re-sale for a 5% commission fee, plus any costs involved in refurbishing the returned item to a saleable state. However, our ability to assist in ANY re-sales will be assessed on a case-by-case basis, rather than assumed.

 

H.G.B work altered, worked on (including but not limited to setting, sizing, re-polishing (including Ultrasonic cleaning, engraving by hand/laser, or Hallmarking/engraving with an alternate name other than our own) or adjusted by anyone other than a qualified member of the H.G.B workshop or circle of workers will immediately revoke any guarantee or fiscal liabilities on the part of H.G.Bespoke and we will not be held liable for any future expense or compensation in regard of said work.

H.G.Bespoke will not be financially liable for damage or failure of any 'Customer Led' designs or the technical inefficiencies brought into play by inexperienced alterations to our manufacturing process. This is to ensure items are made correctly; to our exacting technical standards, rather than allow clients to control anything beyond purely visual design aesthetics.

H.G.B reserves the right to refuse any and all services, without giving reason for refusal, even if deposits have been paid. Clients whose commissions are rejected; for any reason, will receive a full refund within 14 business days (payable to the original account only) No argument will be entered into. In all cases the client will be immediately blocked from the Facebook page and no further correspondence will be accepted or entered into.


H.G.Bespoke will not accept repairs other than H.G.B manufactured pieces, on the rare occasion this may be necessary. All H.G.Bespoke work has a lifetime guarantee against manufacturing defect when worn in normal conditions. Accidental damage is not covered, nor is negligently worn items that result in 'unusual' or potentially avoidable damage.
All damage items will be subject to microscopic workshop analysis to determine cause, prior to any potential repair. Client faulted damage/repairs will be charged at our 'jobbing' hourly rate of 150% of the current 'manufacturing' hourly rate, plus materials, expenses, and VAT.

If a client changes their mind on a chosen design after manufacture has been started but not completed, the client will be responsible in full for time/labour costs and materials used/lost up to that point. If the client changes their mind on a chosen design after the manufacture is completed, the client will be liable for all costs as per quote; and accepted invoice, in full, and any additional costs to re-make any potential alternative design choice.
We will make every effort to discuss design in as much details as required by each individual client, all the way up to the point of invoice, however once a design is chosen, and costed out for invoicing, we cannot be held responsible or liable for altered client brief parameters.
It is not possible to message clients through every single element or process of the manufacture of a specific design; once a design has been chosen, nor is it reasonable to expect this. We do our best to let clients know when a piece has been started, but this is also not always possible due to sheer volume of work. However, a rough time frame is given for the waiting list, so during this period is when we would expect alterations to design or metals to be undertaken. This waiting period is often in excess of 8 weeks, so should offer a suitable cooling period for adjustment to designs to be made by the client. Any alterations made to a design prior to manufacture will incur no extra costs, unless the new design requires the addition of materials/labour costs/diamonds etc.

H.G's Historical ring mounts; sold as pre-loved/second-hand items, are not covered by the H.G.Bespoke lifetime guarantee as these items were not made by H.G.Bespoke. Historicals rings will be sized for the client, at which point stones will be checked. We are not liable for the current wear; or future 'wear & tear' on these second-hand items, other than where workshop negligence is the provable cause of damage or loss.
H.G's Historicals pieces are brought in with the sole conceptual idea that the stones would be re-used in new H.G.B handmade ring commissions. Clients take and wear any of the second-hand items at their own personal and financial risk.

All clients are requested to visit the workshop to view any central stone for a commissioned piece, as this stone will be acquired for your specific item from external sources, rather than from H.G.B stock in almost all cases. Often, once purchased, we are unable to return new stones to source, so clients must take all reasonable measures to ensure they wish to purchase the stone in the first instance, after an initial workshop viewing appointment.
Should you choose to remain as remote clients only, while we will endeavour to take images and video footage of your chosen stone; in several varied lighting situations, and to the best of our abilities, these images do not in any way compare to personally viewing by eye in a face-to-face setting. Our images are not manipulated or enhanced in Photoshop or any Post-production digital suite, so all images/video compare to what we see in the workshop by eye and come to the client in unaltered format.

All first-time clients must accept that they should visit the workshop to assess the stones in the first person; WITHOUT EXCEPTION, when invited to do so. Failure to attend a viewing appointment will not halt the commission process however; unless the client wishes to withdraw, but will instead remove H.G.Bespoke's fiscal liability should you later be unhappy with the stone for any reason whatsoever.

Clients proceeding with commissions undertake to not disclose/disseminate the H.G.B wax 'security seal' on any social media, or in any other manner, such as;  but not limited to digital messaging/photography. The H.G.B wax seal is a proprietary security item, designed to stop imitations of the H.G.B brand and/or makers mark being fostered upon an unknowing public, and is meant not only to protect the work from the H.G.Bespoke workshop but also clients from purchasing fake items.
Only H.G.B pieces valued in excess of £4000 will come with the H.G.B wax seal, produced from the imprint of the H.G.B seal engraved signet ring, and as such ALL clients proceeding with commissions should understand their acceptance of these terms; and continuing with a H.G.Bespoke commissioned piece as compliance with the legal principle of NDA's (non-disclosure agreements) in regards to this security feature. All breaches will be pursued by the full extent of the law regarding NDA agreements.


H.G.Bespoke reserves the right to use all images of H.G.B work; regardless of end user or client; in any way we see fit, unless prior dated and signed agreements are entered into at the beginning of any client relationship.

We respectfully agree to delay the online publishing of time sensitive creations/images and will respect these time frames where commissions are being presented on specific dates, such as; but not limited to, secret birthday commissions, engagement/wedding rings. H.G.Bespoke reserves the right to amend our terms and conditions when and where necessary and without any warning or notification, to maintain complete control over H.G.Bespokes sole right to the intellectual property of the body of work produced in the H.G.B workshop and circle of workshops, as well as to protect any financial vulnerability with regards to any claims for compensation. Any amendments to current terms are immediately active. Invoiced items will lock your terms to the version applicable at the time of invoice.

Ordering from H.G.Bespoke constitutes an explicit understanding of all our CURRENT terms as stated herein and acceptance of ALL terms without reservation or prejudice.

All Diamonds, Precious/Semi-Precious stones of a natural origin will be marked as such and are sold as untreated based on personal knowledge and/or written guarantees provided by the supplier or certification/report of these Diamonds, Precious/Semi-Precious stones.
Diamonds that have been treated by heat/other will be marked as 'Diamond' only, and an explanation of treatment; where known, will be added with the colour designation. Precious/Semi-Precious stones that have been treated by heat/other will be marked by stone type and treatment; where known, will be added with the colour designation.
Where applicable all diamonds supplied; except those found in any H.G's Historicals pieces, Natural or Treated, have been purchased from legitimate sources involved in funding compliances with United Nations Resolutions and are therefore guaranteed to be conflict free goods.
